DOLE reminds employers of the Jan. 15 deadline of 13th month pay compliance reports

OROQUIETA CITY, Misamis Occidental, Jan. 11 (PIA) -- Establishment owners have until Jan. 15, to submit their reports on the compliance of the granting of the 13th month pay to their employees in 2012. 

The law provides that such reports, including the name of establishment, address, principal product or business, total employment and total number of employees benefited, are to be submitted to the nearest regional office of the Department of Labor and Employment (DOLE) not later than January 15 of each year. 

Such reports also include the amount granted per employee, total amount of benefits granted and name, position and telephone number of person giving the information, Jose Robles, provincial director of DOLE-Misamis Occidental said. 

In her Department Advisory No. 02 issued on Nov. 16, 2012, Labor Secretary Rosalinda Dimapilis-Baldoz said all the rank-and-file employees in the private sector are entitled to 13th month pay on or before Dec. 24 of every year. 

The Baldoz said these employees are entitled to such payment regardless of their position, designation or employment status, and irrespective of the method by which their wages are paid, provided that they have worked for at least one month during the calendar year. 

The 13th month pay means one-twelfth (1/12) of the “basic salary” of an employee within a calendar year and that it includes all remunerations or earnings paid by an employer to an employee for services rendered. 

It also includes cost of living allowances, profit-sharing payments, cash equivalents of unused vacation and sick leave credits, overtime pay, premium pay, night-shift differential, holiday pay and all allowances and monetary benefits which are not considered, or integrated, as part of a regular or basic salary of the employee. 

Meanwhile, pursuant to the provisions of Presidential Decree No. 851, and its implementing rules and regulations (IRR), the 13th month pay will be paid not later than December 24 of every year. 

However, an employer may opt to give to her/his employees one-half of the 13th month pay before the opening of the regular school year in June and the remaining half on or before December 24 or every year. 

Robles, however clarified that the two months of maternity leave for the female employees are not included in the computation of the 13th month pay because such employees have no earnings from the company for the period. (RCA-PIA10, Misamis Occidental) 


DepEd X to hold 2013 School Health and Nutrition Congress

CAGAYAN DE ORO CITY, Jan 11 (PIA) -- With the theme, “Moving Forward to Healthy School Children in Region X: Our Commitment,” the Department of Education Region 10 will hold a congress focusing on various strategies on health care delivery to improve health and nutritional status of students.

This Congress is indeed necessary considering its aim to achieve the effective delivery of health and nutrition service for the attainment of optimum health and high academic performance of our students, said Dr. Allan G. Farnazo, Schools Division Superintendent and OIC of the Office of the Regional Director.

Set on January 22-23, 2012, such Congress will discuss present health and nutrition state in the region/division and recommend effective health and nutrition interventions; identify critical issues, gaps and concerns and formulate recommendations/solutions; present the division best practices on sustainable health and nutrition programs, recommend strategies for the effective delivery of health and nutrition services in school and develop an Action Plan for SY 2013-2014.

Among the critical issues and recent concerns to be tackled in the congress are from Dr. Evelyn B. Magsayo of the Department of Health (DOH) on sexual disease situationers, adolescent sexual and reproductive health and teenage pregnancy.

Red Cross Chapter Administrator, Dr. Myra G. Yee will also discuss Enhancing School Health Care Delivery program through RCY and Project 143.

School Violence and Bullying will be presented by Dr. Joey Marie Fabe-Jegonia, Human Resource Clinic and Consultancy. Meanwhile, Drug Addiction Situation in Region X will be disclosed by Police Chief Superintendent Gil Hitosis, regional director, Police Regional Office (PRO)-X. (JMOR/PIA10)
